Downdraft terms of use

Effective 20 October 2026. Downdraft is a game by NimbleMyth, played in a web browser and as an Android app. By playing it you agree to these terms. If you do not agree, do not play it.

The short version

Play it, enjoy it, do not cheat the shared scores, do not copy it and sell it. It comes as it is, with no promises that it will always work. The Android app has ads and an optional purchase that removes them. The web game has no ads.

Who this is for

You must be 13 or older to play. Downdraft is not made for children and is not directed to them. If you are under the age at which you may agree to terms where you live, a parent or guardian must agree for you.

Your licence to play

NimbleMyth gives you a personal, non-commercial, non-exclusive licence to play Downdraft on your own devices. You may not transfer it. The game stays ours: its code, art, sound, music, missions and name are ours or used with permission, and nothing here sells you any of them.

Free to play, ads and the purchase

No account, and offline play

There is no account and no sign-in. Your scores, options and key bindings stay on your device, and clearing the site's data or uninstalling the app deletes them. The game plays without a connection once it has loaded. Anonymous play statistics are sent when you are online unless you turn them off in Options; the privacy page says exactly what.

What you agree not to do

If you seriously or repeatedly break these terms, we may stop the game working for you, and the licence above ends. We will not take away a purchase over a small or honest mistake.

Where the game comes from

Downdraft is an original game inspired by the classic arcade rescue games. It is not affiliated with, endorsed by or connected to the makers of any other game. Other names and marks belong to their owners.

No warranty, and a limit on what we owe

Downdraft is provided as it is and as available. We do not promise that it is free of errors, that it will run on your device, that your saved scores will never be lost, or that it will always be online. We may update it, and one day we may stop offering it.

This does not take away the rights the law gives you. If you paid for the PILOT'S LICENCE, it must work as described; if it does not, you can ask for it to be fixed or refunded.

Apart from those rights, we are not liable for loss nobody could have expected when you started playing, or for lost scores or settings. Otherwise, the most we owe you is the greater of what you paid us in the last 12 months and CAD $50.

These limits do not apply to death or personal injury caused by our negligence, to fraud, to harm we cause on purpose or through gross negligence, or to anything else the law says cannot be limited.

If you live in Quebec: the exclusions and limits in this section do not apply to you where the Consumer Protection Act or the Civil Code of Québec forbids them, and you keep the legal warranty of quality.

If you live in the EU, the UK or Australia: you keep your legal rights for digital content and your consumer guarantees. Nothing in these terms limits them.

Store terms

If you got the game from Google Play, Steam or GOG, that store's terms apply to your download and purchase as well. If these terms and the store's terms disagree about the purchase itself, the store's win. The store's terms do not reduce your rights under consumer law.

Changes

We may change these terms, for example when the game comes to a new store, when we change the ads or the purchase, or when the law changes. The new version is published here with a new effective date, and the game's changelog says so.

If a change affects the purchase or your rights, we announce it in the game's changelog and on this page at least 30 days before it takes effect. A change applies from its effective date, never before, and it will not take away what you already paid for.

If you do not accept a change, you can stop playing. If you bought the PILOT'S LICENCE and the change makes it worse for you, write to us within 30 days after the change and we will refund it.

If you keep playing after the effective date, the new terms apply to you.

The law

These terms are governed by the laws of British Columbia, Canada, and the federal laws of Canada that apply there, except that where you are a consumer, the mandatory consumer law of the place you live still applies to you. If the law where you live allows it, you can also bring a claim in your local courts.
